In the matter that an application to the Committee of Adjustment has been submitted for a minor variance to the Town of Cochrane Zoning By-law 968-2013, as amended, pursuant to Section 45 of the Planning Act, c.P. 13, R.S.O. 1990 as amended for lands known municipally as 70 Seventeenth Avenue and legally described as Con 1 Pt Lots 19 and 20 PT Allow RD Lamarche Con 7 PT Lots 6 and 7 LOC RY48 PLAN M114NB Lots 710 756 TO 760 PT lots 711 712 in Glackmeyer, Roll No. 5639 010 005 27501.

That the decision of the Committee of Adjustment, having given consideration to the applicable provisions of Section 45 of the Planning Act, the Official Plan of the Town of Cochrane, the characteristics of the land and its surroundings as addressed in the Planning Report on the application dated November 9, 2022, the correspondence received and the information presented at the hearing held on November 9, 2022 and the discussion on the matter, hereby APPROVE of the application, subject to the following condition:

  1. That the owner submits a land use compatibility study to the Town of Cochrane prepared by a qualified professional and in accordance with the Ministry of the Environment, Conservation and Parks’ Guideline D-6 indicating the level of impact the industrial use (new planer) would have on the residential area (including noise and dust), along with outlining mitigation measures to address the impacts. Any requirements of the land use compatibility study must be addressed through site plan control prior to obtaining a building permit.

The purpose and effect of the application is to permit the construction of an industrial building (planer) on the subject lands with a reduced setback from a residential zone. Further, to permit a reduction of loading space requirements as described below:

  1. A minimum setback of 85 metres (278.87 feet) for the proposed industrial use (planer) to a residential zone, whereas Section 4.3.1 3) n) requires a minimum distance of 150 metres (492.13 feet) of an industrial use to a residential zone; and
  2. To permit zero (0) loading spaces for the industrial use (planer), whereas Section 3.16 5) would require one (1) loading space.

The last day to appeal this decision is November 29, 2022.
