In the matter of an application to the Committee of Adjustment of the Town of Cochrane under Section 45 of the Planning Act of Ontario, R.S.O. 1990, c.P. 13, as amended for lands municipally known as 144 Fourth Street West and legally described as Lot 286, M114NB, Town of Cochrane being Roll No. 5639 010 002 15800 0000.
That the decision of the Committee of Adjustment, having given consideration to the applicable provisions of Section 45 of the Planning Act, the Official Plan of the Town of Cochrane, the characteristics of the land and its surroundings as addressed in the Planning Report on the application dated March 31, 2026, the correspondence received, the information presented at the hearing held on April 8th, 2026, and the discussion on the matter, hereby APPROVES of the application as applied for.
The purpose and effect of the application is to permit the construction of a three-storey apartment dwelling containing nine (9) residential units, with a ground floor area of 232.44 square meters (2,502 square feet) on the subject lands. The existing building is proposed to remain on the subject lands. The building currently contains office space, along with three (3) residential units. A portion of the commercial space is vacant. Proposed variances are described below:
1. To permit a height of 11 meters (36.09 feet); whereas Section 4.2.1 3) j) of Zoning By-law 968-2013 outlines a maximum height of 10 meters (32.81 feet);
2. To permit an outdoor amenity space area of 44 square meters (473.61 square feet), representing a ratio of 3.67 square meters per dwelling unit; whereas Section 4.2.1 3) m) of Zoning By-law 968-2013 requires a minimum outdoor amenity space ratio of 4.5 square meters per dwelling unit. As there are 12 dwelling units proposed at 144 Fourth Street West, a total outdoor amenity space area of 54 square meters (581.25 square feet) would be required;
3. To permit a total of fourteen (14) off-street parking spaces, representing 1.1 parking space per dwelling unit; whereas Section 3.20 1) of Zoning By-law 968-2013 requires a minimum of 1.25 parking spaces per apartment unit. As there are 12 residential units proposed at 144 Fourth Street West, a total of fifteen (15) off-street parking spaces would be required for the residential use; and
4. To permit six (6) parking spaces on the subject property; whereas Section 3.19 3) of Zoning By-law 968-2013 outlines that all required parking spaces shall be located in their entirety on the same lot as the building or structure or use for which they are required.
The last day to appeal this decision is April 28th, 2026.

Appeal of a Decision
Only individuals, corporations, and public bodies may appeal decisions in respect of applications for consent to the Ontario Land Tribunal. A notice of appeal may not be filed by an unincorporated association or group. However, a notice of appeal may be filed in the name of an individual who is a member of the association or group.
The applicant, the Minister, or any other person or public body who has an interest in this matter may, within 20 days of the making of the decision, appeal to the Tribunal against the decision of the Committee by filing with the secretary-treasurer of the Committee a notice of appeal setting out the objection to the decision and the reasons in support of the objection accompanied by payment to the secretary-treasurer of the fee prescribed by the Ontario Land Tribunal as payable on an appeal from a committee of adjustment to the Tribunal.
The secretary-treasurer of a committee, upon receipt of a notice of appeal filed under subsection (12), shall forthwith forward the notice of appeal and the amount of the fee mentioned in subsection (12) to the Tribunal by registered mail together with all papers and documents filed with the committee of adjustment relating to the matter appealed from and such other documents and papers as may be required by the Tribunal.
If within such 20 days no notice of appeal is given, the decision of the committee is final and binding, and the secretary-treasurer shall notify the applicant and shall file a certified copy of the decision with the clerk of the municipality.
